Terms and Conditions of the HILLS WEAR Online Store

§1 General Provisions

  1. These Terms and Conditions (hereinafter: the “Terms”) define the rules for using the online store available at https://hillswear.com/ (hereinafter: the “Store”).

  2. The Store is operated by HILLS WEAR FILIP GIZA, ul. Szamarzewskiego 21/2, 60-514 Poznań, Poland, VAT ID (NIP): 9241911699, REGON: 381547750 (hereinafter: the “Seller”).

  3. These Terms apply to Consumers and Customers and govern the conclusion of distance sales contracts.

  4. Creating a Customer Account is not required to place an order, unless explicitly stated otherwise by the Store.

  5. The Terms are made available free of charge prior to concluding a contract in a manner enabling their storage and reproduction.


§2 Definitions

For the purposes of these Terms, the following definitions apply:

  1. Consumer – a natural person making a purchase not directly related to their business or professional activity.

  2. Customer – any entity placing an order through the Store.

  3. Store – the online store operating at www.hillswear.com.

  4. Distance Contract – a contract concluded without the simultaneous physical presence of the parties.

  5. Order – a declaration of intent by the Customer to conclude a Sales Contract.

  6. Product – a movable item offered for sale in the Store.

  7. Sales Contract – a contract concluded between the Customer and the Seller.

  8. Pre-Order – a pre-sale in which order fulfilment takes place after the production process has been completed.

§4 Technical Requirements

To use the Store, the following are required:

  1. an Internet-enabled device,

  2. an up-to-date web browser,

  3. an active e-mail account.


§5 General Information

  1. All prices displayed in the Store are gross prices (including VAT), unless stated otherwise.

  2. The Seller shall not be liable for temporary interruptions in the operation of the Store caused by technical issues, force majeure or circumstances beyond the Seller’s control.

  3. Browsing the Store’s assortment does not require registration.


§6 Placing Orders

  1. To place an Order, the Customer must:
    a) select a Product and add it to the shopping cart,
    b) complete the order form,
    c) choose a delivery and payment method,
    d) accept these Terms and submit the Order.

  2. Submitting an Order constitutes the conclusion of a Sales Contract.


§7 Delivery and Payment Methods

  1. Delivery is carried out via:

    • InPost Parcel Lockers®,

    • InPost Courier,

    • international shipping.

  2. Available payment methods include:

    • Visa / MasterCard,

    • BLIK,

    • Apple Pay, Google Pay,

    • PayPal,

    • instant online bank transfers.


§8 Performance of the Sales Contract

  1. The Sales Contract is concluded upon the Customer receiving an order confirmation e-mail.

  2. The order fulfilment time is specified on the Product page.

  3. In the case of Pre-Orders, fulfilment times are indicative and may change due to production-related reasons.

  4. If an Order includes Products with different fulfilment times, the longest stated time shall apply.


§9 Right of Withdrawal

  1. A Consumer has the right to withdraw from the Sales Contract within 14 days from the date of receipt of the Product, without giving any reason.

  2. Withdrawal may be exercised by submitting a clear statement of intent, in particular via the return form available on the Store’s website or by e-mail.

  3. The Consumer bears the direct cost of returning the Product, unless the Seller decides otherwise.

  4. The Consumer is liable for any diminished value of the Product resulting from use beyond what is necessary to establish its nature, characteristics and functioning.

  5. In the event that a returned Product is in a condition that prevents it from being resold as a new product (in particular: makeup stains, visible marks, odors such as perfume, or signs of washing), the Seller may determine a significant or total reduction in the Product’s value, corresponding to the actual degree of use.

    If the reduction in value corresponds to the full value of the Product, no refund shall be due and the Product will be returned to the Customer at the Seller’s expense.

  6. The refund will be made within 14 days of the Seller receiving the returned Product.


§10 Complaints

  1. The Seller is liable for defects in Products in accordance with applicable law.

  2. Complaints may be submitted via e-mail to: store@hillswear.com

  3. Complaints shall be reviewed within 14 days of receipt.


§11 Personal Data

  1. Personal data of Customers are processed in accordance with applicable law and the Privacy Policy available on the Store’s website.


§12 Final Provisions

  1. These Terms are governed by Polish law.

  2. Matters not regulated herein shall be governed by applicable provisions of law.

  3. The Seller reserves the right to amend these Terms for valid legal or organisational reasons.
