Terms and Conditions of the Online Store www.hillswear.com

§ 1

Preliminary Provisions

These Terms and Conditions (hereinafter: "Terms") define the rules for using the online store located at https://hillswear.com/ (hereinafter: "Store").

The Store is operated by HILLS WEAR FILIP GIZA, registered in Poznań (60-514), ul. Szamarzewskiego 21/2, NIP 9241911699, REGON 381547750 (hereinafter: "Seller").

These Terms are addressed to Consumers and define the rules for concluding distance Sales Agreements via the Store. Placing an order requires an active e-mail account.

§ 2

Definitions

Consumer – a natural person making a purchase not directly related to their business or professional activity. Client – any entity making a purchase via the Store. Store – the online store available at www.hillswear.com. Distance Agreement – an agreement concluded without the simultaneous physical presence of the parties. Order – Client’s declaration of intent to conclude a Sales Agreement. Account – Client account in the Store. Registration Form – form for creating an Account. Order Form – interactive form used for placing Orders. Cart – software element displaying selected Products. Product – goods or services available in the Store. Sales Agreement – agreement concluded via the Store. Pre-Order – presale in which production begins only after the presale ends.

§ 4

Technical Requirements

  1. A device with Internet access and a web browser.

  2. Active e-mail account.

  3. Cookies enabled.

§ 5

General Information

  1. The Seller is not liable for interruptions caused by force majeure or third-party interference.

  2. Browsing Products does not require creating an Account.

  3. All prices displayed in the Store include VAT (gross prices).

§ 6

Order Placement

To place an Order, the Client must:

  1. Select a Product and click “Add to cart”.

  2. Fill out the Order Form (logging in is optional).

  3. Provide delivery information.

  4. Choose a payment method and complete the payment.

§ 7

Delivery and Payment Methods

Delivery options:

  • InPost Parcel Lockers (Paczkomaty®)

  • InPost Courier

  • International Shipping

Payment methods (via Shopify Payments and Przelewy24):

  • Visa

  • MasterCard

  • BLIK

  • Apple Pay

  • Google Pay

  • Online transfers

  • Electronic payments

  • PayPal

§ 8

Order Fulfillment

  1. The Sales Agreement is concluded once the Client receives an order confirmation e-mail.

  2. Products are shipped within the time specified on the Product page.

  3. Pre-Order:

    • Fulfillment time is longer and specified on the Product page.

    • The provided date is approximate and may change due to production factors; the Client will be informed by e-mail.

  4. If multiple Products with different delivery times are ordered, the longest time applies.

  5. Order processing begins after successful payment authorization.

  6. International Clients: all customs duties, import taxes, and clearance fees are borne by the Client. If the Client refuses to pay them and the shipment is returned, all related costs will be deducted from the refund.

  7. Worldwide shipping is available.

§ 9

Right of Withdrawal

  1. The Consumer may withdraw from the agreement within 14 days of receiving the Product.

  2. Withdrawal must be submitted using the return form available on our website in the "Returns" section; submitting an e-mail statement alone is not sufficient.

  3. The Consumer covers the cost of returning the Product, except when using InPost "Szybkie Zwroty" (Quick Returns), where a return shipping fee of 15 PLN is deducted from the refund.

  4. For hygiene reasons, products that cannot be resold after opening—such as personal underwear and protective masks—are not eligible for return.

  5. Refunds are issued to the payment method used in the original order.

§ 10

Complaints and Warranty

  1. All Products are new and original.

  2. The Consumer may submit a complaint within 2 years of receiving the Product.

  3. Complaints must be sent to store@hillswear.com and include:

    • name and surname,

    • order number,

    • description of the defect,

    • photos documenting the defect,

    • a complaint request.

  4. Complaints are processed within 14 days. Lack of response within this period means the complaint is accepted.

  5. Personal data processed during the complaint procedure is described in the Privacy Policy.

§ 11

Out-of-Court Dispute Resolution

Consumers may use out-of-court complaint and dispute resolution methods, including assistance from the Consumer Ombudsman or via the ODR platform: http://ec.europa.eu/consumers/odr/.
